1. Acceptance of Terms

By accessing this web site, you are agreeing to be bound by these website Terms of Service (TOS), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright law.

2. Description of Service

LocalGolfTourneys.com is striving to be the premier service on the internet for golfers to find golf tournaments in their local areas.  Our objective is to provide a simple and easy method for tournament organizers to host their events and for golfers to find and register for golf tournaments.  LocalGolfTourneys.com also provides a comprehensive list of golf courses and allows the user(s) to post golf course information.

3. User Conduct

You understand that all information, data, text, photographs, graphics, messages, or other materials (Content), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not LocalGolfTourneys.com, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service.  LocalGolfTourneys.com does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will LocalGolfTourneys.com be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.
You acknowledge that LocalGolfTourneys.com and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or move any Content that is available via the Service. LocalGolfTourneys.com and its designees shall have the right to remove any Content that violates the Terms of Service or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content.

4. Listing Your Tourney with LocalGolfTourneys.com

In consideration of your use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service registration form (such information being the Registration Data) and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or LocalGolfTourneys.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, LocalGolfTourneys.com has the right to suspend or terminate your listing and refuse any and all current or future use of the Service (or any portion thereof). LocalGolfTourneys.com is concerned about the safety and privacy of all its users, particularly children. For this reason, and to be consistent with PayPal's Terms of Use, you must be at least 16 years of age to list a golf tournament with LocalGolfTourneys.com.

• Fees – There are no fees for listing a tournament with LocalGolfTourneys.com, unless the tournament organizer chooses to list their torunament as a 'Featured Tournament'.
• Upon registering a Golf Tournament with LocalGolfTourneys.com a 10% service charge or $5 flat fee for tournaments listed at less than $50 per golfer, will automatically be added to the advertized cost per golfer for providing our service. For example, if a tournament costs $50 per golfer, the cost of the event will be advertised at $55.
• By choosing to list the tournament as a 'Featured Tournament', it will be listed on the Home page in the ‘Featured Tournaments’ section until the ‘Registration Closing Date’ for the tournament.  The ‘Featured Tournaments’ list will randomly show 5 tournaments when the Home page loads.  The tournament organizer will be charged a fee of $20 for this service which will be deducted from the final payout.
• Cancellations – Upon cancellation of a golf tournament, it is not the responsibility of LocalGolfTourneys.com to repay the registrant.  Upon cancellation of an event, the tournament organizer will be required to repay each registrant that has registered for the tournament through LocalGolfTourneys.com.  LocalGolfTourneys.com will not repay the fees added to the tournament cost for providing our service.

5. Registering with LocalGolfTourneys.com

In consideration of your use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service registration form (such information being the Registration Data) and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete.  LocalGolfTourneys.com is concerned about the safety and privacy of all its users, particularly children. For this reason, and to be consistent with PayPal's Terms of Use, you must be at least 16 years of age to register for a golf tournament provided by LocalGolfTourneys.com.

• Fees – The registrant is aware that a 10% charge has been added on top of the original cost of the tournament, or a flat $5 fee for tournaments that cost less than $50.. 
• Cancellations – Upon cancellation of a golf tournament, it is not the responsibility of LocalGolfTourneys.com to repay the registrant.  Upon cancellation of an event, the tournament organizer will be required to repay each registrant that has registered for the tournament through LocalGolfTourneys.com.  LocalGolfTourneys.com will not repay the fees added to the tournament cost for providing our service.

6. Payment Processing Information

All monetary collections will be made from you directly through PayPal and not directly through LocalGolftTourneys.com.  Hence it will be necessary for LocalGolfTourneys.com users and their paying Customers to transact through PayPal, and be subject to the applicable PayPal Terms of Use.   LocalGolfTourneys.com is not affiliated with PayPal, and neither is the agent or employee of the other, and neither is responsible in any way for the actions or performance (or lack thereof) of the other.  The terms of this TOS shall not in any way supersede the terms of any other service provider, nor shall the terms of service of any other service provider supersede the terms of this TOS with respect to the SERVICE.

7. Dealings with Advertisers

• LocalGolfTourneys.com reserves the right to deny any advertisements that are deemed inappropriate for our users.  The fee structure defined for ad placement on LocalGolfTourneys.com is non-negotiable. LocalGolfTourneys.com agrees to split (50%) sponsor advertising revenues with the golf tournament oganizer of the tournament that is being sponsored.
• Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that LocalGolfTourneys.com shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

8. LocalGolfTourneys.com Proprietary Rights

You acknowledge and agree that the Service and any necessary software used in connection with the Service (Software) contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the Service or by advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by LocalGolfTourneys.com or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part.

9. DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

• YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. LOCALGOLFTOURNEYS.COM EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
• LOCALGOLFTOURNEYS.COM MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS; (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS; AND (v) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
• ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
• NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM LOCALGOLFTOURNEYS.COM OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS OF SERVICE.
